International Negotiation

International negotiation is a consensual method for the management and resolution of disputes in which the parties, either directly or with the assistance of specialized advisors, seek to reach an agreement through dialogue and cooperation.

This mechanism is particularly used in disputes involving international elements, such as cross-border commercial relationships, international contracts, or disputes between parties domiciled in different States. International negotiation is grounded in the autonomy of the parties’ will and in the principles of good faith, flexibility, and confidentiality.

International negotiation allows the parties to preserve their commercial relationships, reduce costs and time, and design solutions tailored to their interests, whether as a standalone mechanism or as a prior or complementary stage to other dispute resolution methods, such as mediation or arbitration.
