National Commercial Arbitration

Peruvian domestic commercial arbitration applies to disputes arising between parties domiciled within the territory of the Republic of Peru and is primarily governed by Peruvian law. It is a widely used mechanism for resolving contractual disputes among companies, business partners, and individuals.

This type of arbitration is governed by Legislative Decree No. 1071, the Arbitration Law, which recognizes the autonomy of the parties’ will and ensures a flexible, confidential, and efficient procedure. Compared to state courts, domestic commercial arbitration offers greater speed, specialized arbitrators, and legal certainty, consolidating its role as an effective mechanism for resolving commercial disputes within the domestic sphere.
